These Terms of Use ("Terms") apply to the VaultCave app for iPhone and iPad (the "app") and this website, provided by Pedro Lopes, Portugal ("we", "us"). By downloading or using the app you agree to them. If you don't agree, please don't use the app.
1. The licence
We grant you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apple's Standard Licensed Application End User License Agreement also applies; where these Terms and Apple's agreement differ, Apple's terms on the licence itself prevail.
You may not copy, modify, reverse-engineer (except where the law allows it), resell or redistribute the app.
2. Your content and your responsibility
Your content stays yours. We don't receive it, can't see it and claim no rights to it.
Because your vaults are encrypted with keys only you hold:
- Keep your recovery phrase safe. It is the only way to restore a vault if you forget its pattern or passcode or lose your iPhone. We cannot reset, recover or replace it.
- Features that erase data do exactly that. If you turn on "erase after 10 failed attempts" or set up duress mode, vaults on the device can be permanently erased. Restoring is only possible from an encrypted backup with the vault's recovery phrase.
- Exports are readable. A file you export or share without encryption is no longer protected by the app.
You are responsible for backing up anything you can't afford to lose and for keeping your device, Apple ID and recovery phrases secure.
3. Acceptable use
You agree to use the app only lawfully. In particular you won't use it to store, share or distribute content that is illegal, that sexually exploits or endangers children, or that infringes someone else's rights, and you won't use encrypted sharing to harass anyone or to distribute malware. We can't see your content, but these rules still apply to you, and we will cooperate with lawful requests to the extent we're able (in practice we hold no content or user data to provide).
4. Free version, Pro and subscriptions
The app is free to download and includes one vault with up to 100 items and encrypted backup. VaultCave Pro unlocks additional features and is available as:
- a weekly auto-renewing subscription,
- a yearly auto-renewing subscription, which may include a free trial, or
- a one-time lifetime purchase.
Prices are shown in the app before you buy, in your local currency, and may change; a price change never affects a period you've already paid for, and Apple will tell you in advance where required.
Auto-renewal. Payment is charged to your Apple ID when you confirm the purchase. Subscriptions renew automatically at the same price and length unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within the 24 hours before the period ends. If a free trial is offered, any unused part of it ends when you buy a subscription. You can manage or cancel subscriptions in iOS Settings → your name → Subscriptions, or from the app's Settings.
Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com. We can't issue refunds directly.
When Pro ends, the app returns to the free version's limits. Your vaults and content are never deleted because a subscription ended; protective features you had already turned on (such as duress mode or erase-on-failure) stay on until you turn them off.
5. Disclaimer
The app is provided "as is" and "as available". We work hard to make it secure and reliable, but to the fullest extent the law allows we make no warranties, express or implied, including fitness for a particular purpose, and we don't guarantee that the app will be uninterrupted or error-free or that data can never be lost. Nothing in these Terms limits rights you have as a consumer that can't be limited by contract.
6. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential damages, or for loss of data resulting from forgotten patterns, passcodes or recovery phrases, from erase features you turned on, from device loss or failure, or from content you exported. Our total liability for any claim relating to the app is limited to the amount you paid for it in the 12 months before the claim. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
7. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app. Apple is not responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims. If a third party claims that the app infringes its intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
8. Changes and termination
We may update these Terms; we'll change the date above and, for meaningful changes, mention them in the app's release notes. Continuing to use the app after an update means you accept it. You can stop using the app at any time by deleting it. The licence ends automatically if you breach these Terms.
9. Governing law
These Terms are governed by the laws of Portugal, without affecting the mandatory consumer protections of the country where you live. Disputes go to the courts of Portugal, unless the law gives you the right to bring them in your own country.
